Right of withdrawal

You can withdraw from the contract you entered into with Franky's Best within 14 days without giving any reason. This period begins on the day on which you, or a third party designated by you (other than the carrier), take possession of the goods; in the case of subscriptions, this period begins on the day on which you, or a third party designated by you (other than the carrier), take possession of the first goods. You exercise your right of withdrawal by means of a clear statement, either by post to Franky's Best (sole proprietorship), Kirchstrasse 13a, 10557 Berlin, Germany, or by email to info@frankysbest.de. To meet the withdrawal deadline, you must send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired and return the goods to us, Franky's Best (sole proprietorship), Kirchstrasse 13a, 10557 Berlin, Germany, within the period defined below.

Consequences of the revocation

In the event of a valid cancellation, we will reimburse all payments received from you for the cancelled contract, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than our cheapest standard delivery option), without undue delay and no later than fourteen days from the day on which we received your cancellation notice. We will use the same payment method for the reimbursement that you used for the original transaction, unless expressly agreed otherwise. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. The goods must be returned to Franky's Best (sole proprietorship ) , Kirchstrasse 13a, 10557 Berlin , without undue delay and in any event no later than 14 days from the day on which you communicated your cancellation of this contract to us. You meet the deadline if you send the goods before the fourteen-day period expires. You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods if this diminished value is not due to handling necessary for testing the condition, properties, and functionality of the goods.

Exclusion of the right of withdrawal

However, the right of withdrawal does not apply to distance contracts for the supply of goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;

  • for the supply of goods which are liable to deteriorate or expire rapidly;
  • for the delivery of newspapers, magazines or illustrated magazines, with the exception of subscription contracts.
  • for the supply of alcoholic beverages, the price of which was agreed upon at the conclusion of the purchase contract, but whose delivery can only take place after 30 days and whose current value depends on fluctuations in the market over which the entrepreneur has no influence.

The right of withdrawal expires prematurely in the case of distance contracts.

  • for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if the seal has been removed after delivery;
  • for the supply of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.
